These Terms and Conditions
These are the terms and conditions on which we supply products to you. You should ensure that you read the section entitled “Terms of Website Use” if you use our website to view or order any products or otherwise engage with us via our Trinity Gift Shop website [https://www.trinitygiftshop.trin.cam.ac.uk]. 
 Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

 

Entire agreement

These terms and conditions and other notices elsewhere on the Trinity Gift Shop website (https://www.trinitygiftshop.trin.cam.ac.uk) contain the whole agreement between us and you relating to the supply of products. No other terms or conditions will form part of the Contract, unless agreed by us in writing and signed by an authorised Trinity College employee.
 

Information about us

Trinity Gift Shop (https://www.trinitygiftshop.trin.cam.ac.uk with default Shopify address https://www.trinitygiftshop.myshopify.com) is a site operated by the Alumni Relations and Development Office, Trinity College, Trinity Street, Cambridge, CB2 1TQ (“we”, “our”,”us”). The site is solely for the promotion of our products in the UK.  Our Registered Charity Number is 1137604 and our Value Added Tax number is 214 2462 02. If you have any questions, please contact us at on the address above or, 01223 761527 or trinitygifts@trin.cam.ac.uk. If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.
 

Ordering products

After placing an order, you will receive an email from us acknowledging that we have safely received it. This does not mean that your order has been accepted. All orders are subject to acceptance by us. If your order has been accepted, we will send an email to confirm dispatch of your order.
 
The contract between us (the “Contract”) will only be made when we send you the email to confirm dispatch.  Only those products listed in the email as being dispatched will be included in the Contract. If we are unable to accept your order, we will inform you of this by e-mail and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.
 

Our Products

The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images. The packaging of the product may vary from that shown in images on our website.
 

Your rights to make changes

You are able to make changes to your order up to the point at which you click on the button to place your order on the Proceed to Checkout section of the purchasing process. If you wish to make a change to the product you have ordered after placing your order, please contact us. We will let you know if the change is possible. If it is possible, we will let you know about any changes to the price of the product, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. If we cannot make the change or the consequences of making the change are unacceptable to you, you may want to end the contract (see the “Your rights to end the contract” section of these terms and conditions).
 

Delivery 

Currently, we deliver Trinity Gift Shop items to addresses within the United Kingdom only. Please let us know by email to trinitygiftshop@trin.cam.ac.uk if you are interested in shipment to another country and we will investigate whether further options may be possible.
 
The costs of delivery will be as displayed to you on our website. We will deliver the products to you as soon as reasonably possible and in any event within 30 days after the day on which we accept your order.
 
If our supply of the products is delayed by an event outside our control, then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.
 
The products will be at your risk at the time that they enter into your possession, or a person identified by you that is authorised to take possession of the products. Ownership of the products will only pass to you at the time of delivery.
 

Your rights to end the contract

Ending the contract because of something we have done or are going to do

If you are ending a contract for a reason set out at (a) to (c) below the contract will end immediately and we will refund you in full for any products which have not been provided and you may also be entitled to compensation. The reasons are:
  • we have told you about an error in the price or description of the product you have ordered and you do not wish to proceed;
  • there is a risk that supply of the products may be significantly delayed because of events outside our control; or
  • you have a legal right to end the contract because of something we have done wrong.

Exercising your right to change your mind (Consumer Contracts Regulations 2013) 

If you are a consumer, you have the legal right to cancel. A consumer is any natural person who carries out transactions not for commercial or self-employment purposes.
 
You have the legal right to cancel your order within 14 days, without giving a reason. The cancellation period of 14 days starts with the day you or a person of your choice, who is not the deliverer, have/has received the goods.
 
This legal right to cancel does not apply to products which are made to your specifications or personalized.
 

Ending the Contract if there is a problem with the product

 
If you have any questions or complaints about the product, please contact us.
 
We are under a legal duty to supply products that are in conformity with this contract. The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following: 
  • Up to 30 days: if your goods are faulty, then you can get an immediate refund.
  • Up to six months: if your goods can’t be repaired or replaced, then you’re entitled to a full refund, in most cases.
  • Up to six years: if your goods do not last a reasonable length of time you may be entitled to some money back.
You also have the legal right to change your mind, as set out above.
 
Nothing in these terms will affect your legal rights.
 
If you wish to exercise your legal rights to reject defective products you must post them back to us. We will refund you the costs of postage.
 

How to end the contract with us 

To end the contract with us, please let us know by calling us on 01223 761527 or e-mailing us at trinitygiftshop@trin.cam.ac.uk. Please provide your name, home address, details of the order and, where available, your phone number and email address. Alternatively, you may write to us by post to Alumni Relations and Development Office, Trinity College, Trinity Street, Cambridge, CB2 1TQ, including details of what you bought, when you ordered or received it and your name and address.
 
If you end the contract for any reason after products have been dispatched to you or you have received them, you must return them to us. You must post them back to us at Alumni Relations and Development Office, Trinity College, Trinity Street, Cambridge, CB2 1TQ. If you are exercising your legal right to change your mind you must send off the goods within 14 days of telling us you wish to end the contract.
 
We will pay the costs of return if the products are faulty or misdescribed or if you are ending the contract because we have told you of an upcoming change to the product or these terms, an error in pricing or description, a delay in delivery due to events outside our control or because you have a legal right to do so as a result of something we have done wrong.
 
In all other circumstances (including where you are exercising your right to change your mind) you must pay the costs of return. We recommend that you use a postal or courier service that insures you for the value of the products you are returning and you should keep proof of postage
 
We will refund you the price you paid for the products including delivery costs, within 14 days starting with the day we received your cancellation notice. In order to refund your money, we will use the same transaction card that you chose in order to pay, unless we specifically agreed on an alternative refund method. We won’t charge an extra fee for the refund under any circumstances. We can deny the refund until we have either received the products or proof that you have sent them.
 
If you want to return or exchange your products, you must take reasonable care of them and they should be returned to us in their original condition, which means that: 
  • You can open the packaging to look at and, when applicable, try on the products but all products must be unused and undamaged.
  • The original packaging should be retained and returned.
If you are exercising your right to change your mind, and you fail to take reasonable care, we may reduce your refund of the price (excluding delivery costs) to reflect any reduction in the value of the products, if this has been caused by your handling them without reasonable care. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.
 
Jewellery must be returned in perfect condition, unworn, and in the original packaging within 30 days. Due to health and safety legislation, earrings cannot be exchanged or returned. This does not affect your statutory and legal rights.
 
If you are exercising your right to change your mind, the maximum refund for delivery costs will be the costs of delivery by the least expensive delivery method we offer. For example, if we offer delivery of a product within 3-5 days at one cost but you choose to have the product delivered within 24 hours at a higher cost, then we will only refund what you would have paid for the cheaper delivery option.
 

Prices

The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.
 
Please be aware that the prices displayed on our site include Value Added Tax where applicable but exclude delivery costs, which will be added to the total amount due. The applicable delivery costs will be clearly displayed during the checkout process.
 
We take all reasonable care to ensure that the price of the product advised to you is correct. However, if we discover there is a pricing error, we will normally, at our discretion, either: 
  • contact you and give you the option of reconfirming your order at the correct price or cancelling it; or
  • reject your order and notify you of the rejection. 

Payment

You must pay for the products before we dispatch them. We will not charge your credit or debit card until we dispatch the products to you.
 
We accept payment with the following credit or debit cards: Visa credit and debit cards, MasterCard credit and debit cards, American Express credit and charge cards, Discover and Diners cards, Apple Pay, Google Pay, Microsoft Pay, Afterpay/Clearpay and Click to Pay.
 
By submitting an order to us through our site, you are confirming that the payment details provided on your order are valid and correct. All transactions will be in pounds sterling. Non-UK credit card providers and banks will determine the exchange rates to be applied and may add an additional processing or administration charge in relation to such payments which non-UK card holders will be liable to pay.
 
When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods,
If we reject or cancel your order for any reason, this charge will be credited back to your debit or credit card. Items returned by post, and meeting the conditions of our Returns Policy, will be refunded to your debit or credit card.
 

Privacy

Your privacy matters to us. We encourage you to read it, as using our service means that you are agreeing to us using the information you share with us to order, pay and arrange delivery of your goods, as well as other uses as set out in the Gift Shop Privacy Policy. You should also read our Website Data Protection Statement [https://www.trin.cam.ac.uk/alumni/keep-in-touch/information/dataprotectionstatement] which sets out other information about our processing of your personal information when you visit our website.
 
When ordering any products from our site, you will be asked to complete a registration process. Information that you provide on our site must be complete and accurate. You must not impersonate any other person or entity or use a false name or a name that you are not authorised to use.
 
From time to time, we may make other services available which also require registration and we will process personal information about you in accordance with our relevant privacy policy, which will be notified and made available to you.
 

Privacy of Children on Our Website

Our site is not intended for use by children under the age of 18, and we will not knowingly collect any information from any person below the age of 18.
 
In order to contract with Trinity College and the Trinity Gift Shop you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us.
 

Our responsibility to you

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products as summarised in the ‘Ending the Contract if there is a problem with the product section of these terms and conditions’.
 
We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
 

Rights of third parties

This contract is between you and us. No other person shall have any rights to enforce any of its terms.
 

Severance

Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
 

No Waiver

If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you, but we continue to provide the products, we can still require you to make the payment at a later date.
 

Our right to vary these Terms and Conditions

We have the right to revise and amend these terms and conditions. Any order you have already placed with us will not be affected by any such revision or amendment. You will be subject to the terms and conditions in force at the time that you order products from us.
 

Law and Jurisdiction

These terms are governed by English and Welsh law and you can bring legal proceedings in respect of the products in the English and Welsh courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English or Welsh courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English or Welsh courts.
